Dutch Supreme Court Holds Key to F-35 Supply Line to Israel

Date:

The Dutch Supreme Court holds the key to a significant supply line for Israel’s F-35 fighter jets. Its imminent ruling will decide whether to uphold a ban on the export of spare parts from a key European warehouse, a case prompted by the ongoing war in Gaza.
The legal action was brought by three rights groups who seek to sever this logistical link, arguing that it makes the Netherlands a party to alleged violations of international humanitarian law. They claim the government has a legal duty to intervene.
Their case was validated by an appeals court in February 2024, which ordered a halt to the shipments. The government appealed this decision, arguing that it was interfering in a multinational defense program and overstepping its judicial authority.
The government has also consistently argued that its role is simply to host the U.S.-owned parts, and that a ban would be an ineffective gesture. This has been a core element of its defense as it seeks to have the ban lifted.
The Supreme Court’s decision is being watched closely by military planners and human rights advocates alike. It comes at a time of intense international scrutiny of the Gaza war, which began on October 7, and could set a precedent for other nations that host elements of the global military supply chain.
