Court to Trump: Your Tariff Strategy is Not Authorized by Law

A federal appeals court has delivered a clear message to Donald Trump: your global tariff strategy is not authorized by the law you cited. The court ruled that his use of the International Emergency Economic Powers Act (IEEPA) to impose duties was illegal.
The 7-4 decision states that the IEEPA was never intended by Congress to be a tool for widespread economic protectionism. The ruling emphasizes that the power to impose tariffs is a legislative function, and the IEEPA does not contain the explicit delegation of that power to the president.
The verdict throws numerous international trade deals into question. These pacts were negotiated by countries seeking to avoid the IEEPA tariffs. With those tariffs now declared unlawful, the primary incentive for adhering to the deals has been removed.
An appeal to the Supreme Court is forthcoming, where this fundamental issue of presidential power will be decided. The case has become a critical examination of the checks and balances in the U.S. system of government, with billions of dollars in tariffs hanging in the balance.
